It didn't bounce, flutter, or glide (or wander) as a Kestrel does, especially in a light breeze. The dark back half of the tail was different than the Kestrel's light one, and it was thicker + shorter. Also downy chicks would not be able to fly. Very small size and all black color eliminated other Rail species. The golden yellow cap reminded me of a chestnut-sided but the lack of streaking on the back and absence of any markings on the side eliminated this bird also.
